Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Sublim.it service (the “Service”) operated by PIXELHUB STUDIO (“we”, “us”), and the purchase of paid plans and credits. They serve as both terms of use and terms of sale. By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service.

1. The Service

Sublim.it is an online tool that enhances real-estate photographs using artificial intelligence. It automatically improves the lighting, perspective and colours of the photos you upload (and, for exterior shots, the sky), to produce clean, professional-looking listing images. The Service enhances your existing photos; it does not add or remove objects, and results are generated automatically.

2. Eligibility and account

You must be at least 18 years old to use the Service. You agree to provide accurate information when registering, to keep your login credentials confidential, and to be responsible for all activity under your account. You may sign up with an email address and password or via Google sign-in. You are responsible for ensuring you have the necessary rights to the photographs you upload.

3. Plans, credits and prices

One credit allows the enhancement of one photo. New accounts receive a number of free credits, as indicated on the website at the time of sign-up.

• Subscriptions: paid plans (billed monthly or yearly) provide a monthly allowance of photo enhancements, which renews each billing period.
• Credit packs: one-time purchases of additional credits. Purchased pack credits do not expire.
• Unused subscription (monthly allowance) credits do not roll over and expire at the end of the billing period; purchased pack credits remain available until used.

Prices are displayed on the pricing page in euros. The applicable VAT and the total amount are shown before payment at checkout. We may change our prices at any time; the price applicable to a subscription is the one in force at the time of each renewal, and you will be informed of any change in advance.

4. Payment and billing

Payments are processed by our payment provider, Stripe. We do not store your full payment card details. Subscriptions are billed in advance and renew automatically for the same period until cancelled. By subscribing, you authorise us (via Stripe) to charge the applicable amount at each renewal.

5. Right of withdrawal (consumers)

The Service supplies digital content and a service that is performed immediately. When you launch the enhancement of a photo, you expressly request immediate performance of the Service and acknowledge that you will lose your 14-day right of withdrawal once performance has begun, in accordance with Article L221-28 of the French Consumer Code. For any paid amount where no enhancement has yet been performed, a consumer may exercise the 14-day right of withdrawal by contacting us at contact@sublim.it.

6. Cancellation and no commitment

Subscriptions have no minimum commitment period. You may cancel at any time from your account or by contacting us. Your plan remains active until the end of the period already paid for, and is not renewed thereafter; you can resume it later. Except as required by law or as set out in Section 5, payments already made are non-refundable.

7. Your content and licence

You retain all ownership rights to the photographs you upload and to the enhanced images you obtain. You grant PIXELHUB STUDIO a limited, non-exclusive licence to host, store, process and display your photographs solely for the purpose of operating and providing the Service to you (including processing by the third-party AI providers described in our Privacy Policy). You represent that you own or have all necessary rights and authorisations for the photographs you upload, and that they do not infringe any third-party rights or any applicable law.

8. Acceptable use

You agree not to use the Service to:

• upload content that is unlawful, infringing, defamatory, or that you are not authorised to use;
• upload photographs of properties without the authorisation of the relevant rights holder;
• attempt to disrupt, overload, reverse-engineer, copy or resell the Service;
• circumvent usage limits, credits or security measures.

9. AI results and free re-generations

Enhancements are generated automatically and results may vary depending on the input photo; they are not guaranteed to meet every expectation. To help you obtain a result you are satisfied with, each photo can be re-generated for free up to two times (three versions in total) without using an additional credit.

10. Free plan watermark

Enhancements downloaded on the free plan include a small Sublim.it watermark. The watermark is removed for images downloaded under any paid plan or credit pack.

11. Intellectual property

The Service, including its software, design, brand, logos and content (other than your photographs), is and remains the exclusive property of PIXELHUB STUDIO. These Terms grant you only a personal, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

12. Availability and changes

We provide the Service on a best-efforts basis. We may modify, suspend or discontinue all or part of the Service, and carry out maintenance, at any time. We will make reasonable efforts to limit any disruption.

13. Warranties and liability

The Service is provided “as is”. To the fullest extent permitted by law, we exclude implied warranties and we are not liable for indirect or consequential damages, nor for any loss arising from your failure to retain copies of your original photographs. Nothing in these Terms limits liability that cannot be limited by law. Consumers continue to benefit from their statutory guarantees, including the legal guarantee of conformity and the guarantee against hidden defects under French law.

14. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service unlawfully. You may stop using the Service and close your account at any time.

15. Governing law and disputes

These Terms are governed by French law, without prejudice to the mandatory protective provisions applicable to consumers in their country of residence. In the event of a dispute, we encourage you to contact us first at contact@sublim.it to seek an amicable solution before any legal action.

16. Changes to these Terms

We may update these Terms from time to time. The “last updated” date above indicates the latest revision. Material changes will be communicated to you, and continued use of the Service after the changes take effect constitutes acceptance.
